Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JaenX platform, website and APIs (the "Service"). By using the Service you agree to these Terms. If you are using JaenX on behalf of an organisation, you confirm you are authorised to bind that organisation.

1. The Service

JaenX provides WhatsApp messaging automation built on the WhatsApp Business Cloud API operated by Meta Platforms, including a visual flow builder, chatbot automation, appointment booking, ordering, e-commerce, reminders, analytics and a REST API. The Service depends on third-party platforms (including Meta) that are outside our control.

Because the Service is built on the WhatsApp Business Cloud API, you must comply with the WhatsApp Business Policy, the WhatsApp Business Messaging Policy, and Meta's platform terms at all times. This includes respecting opt-in requirements, the 24-hour customer service window, approved message templates outside that window, and messaging rate limits. Violations may result in your WhatsApp number or account being restricted by Meta, and may lead to suspension of your access to the Service.

JaenX is offered on a subscription basis. Plan pricing is provided on a quote basis — please contact us for a tailored quote. Fees for the Service are separate from any messaging charges that Meta levies for WhatsApp conversations, which are billed under Meta's own pricing. Unless stated otherwise, fees are non-refundable and payable in advance for each billing period.

6. Intellectual property

The Service, including its software, design and trademarks, is owned by JaenX or its licensors. You retain ownership of your own content and data. You grant us a limited licence to process your content solely to provide the Service.

7. Limitation of liability

To the maximum extent permitted by law, JaenX is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. We are not responsible for events outside our reasonable control, including WhatsApp/Meta API downtime, rate-limiting, message rejection, account restrictions, or changes to Meta's policies or pricing. Our total aggregate liability for any claim is limited to the fees you paid to JaenX in the three months preceding the claim.

8. Disclaimers

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or that messages will always be delivered, as delivery depends on Meta and recipient settings.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, violate WhatsApp/Meta policies, or where required by law. Upon termination, your right to use the Service ends; data handling after termination is described in our Privacy Policy and Data Deletion Instructions.

10. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing law
